Asylum and the European Convention on Human Rights (Human Rights Files No. 9) (28/11/2007)

Political upheavals, economic reforms, social instability and civil war have all been factors contributing to changes in the mixed flows of migrants both to and within Europe. Many of those in need of international protection are forced to seek it in Europe and the new member states of the enlarged Council of Europe are now also experiencing the arrival of asylum seekers. This revised edition considers the substantial body of case law of the European Court of Human Rights which has examined the compatibility of the Convention with measures taken by states in relation to all aspects of the asylum process. It also observes the role of subsidiary protection offered by the Strasbourg organs in protecting those at risk of prohibited treatment. In addition, the study considers the increasingly relevant provisions of EU law developments in the field, as well as measures taken in the context of terrorist threats – both of which have had a significant impact on the practical circumstances and law on refugees and asylum seekers.

State of human rights and democracy in Europe (04/12/2007)

Protecting human rights and promoting democracy are the Council of Europe's two main tasks. But to what extent do the 47 member states live up to their commitments in these two crucial areas? The Parliamentary Assembly of the Council of Europe tried to answer this questioning an unprecedented political debate during its April 2007 session. This first debate was attended by parliamentarians from throughout Europe, the main partners in the global human rights community - the UN High Commissioner for Human Rights, Amnesty International and Human Rights Watch - and the managers of the main Council of Europe monitoring mechanisms. The texts contained in this publication show that despite undoubted progress, Europe is still afflicted by serious human rights violations, including enforced disappearances, extra-judicial executions, torture and secret detentions, as well as shortcomings in democratic processes.

Jan 10th: Help us pack the hearing room as we say no to the death penalty!

The California Commission on the Fair Administration of Justice will hold the first of three public hearings on the death penalty on January 10th in Sacramento, CA. The hearings will draw input from experts and members of the public in an unprecedented effort to address serious flaws in California's death penalty system.

At the upcoming hearings, experts in the field will present research and testimony on racial and geographic disparities in death sentencing, costs, problems with juries and other important topics. The Commission will also hear from the public and listen to the experiences of victims' families and others affected by the death penalty system.
